These Terms of Service govern your access to and use of the NewTechBio website, mobile site, applications, and related services, as well as any purchase of products from NewTechBio, Inc.
By accessing or using our website or purchasing products in any manner, including online, mail, or phone, you agree to these Terms.

If a conflict exists between documents, the following order of precedence applies:
- These Terms control purchases, risk allocation, warranty limitations, liability limits, and dispute resolution.
- Shipping and Returns controls shipping procedures, transit estimates, tracking, freight approvals, delivery logistics, return windows, refund procedures, and performance guarantees.
- Conditions of Use controls site access, intellectual property, and account governance.
- Privacy Policy controls data collection, data use, retention, and privacy rights.
2. Modification of Terms
NewTechBio, Inc. may revise these Terms at any time. The revised version will display a clear “Last Updated” date. Continued use of the website or purchase of products after changes are posted constitutes acceptance of the revised Terms.
3. Order Processing and Acceptance
All orders are subject to review and acceptance by NewTechBio, Inc. Receipt of an order confirmation does not constitute acceptance.
We reserve the right to reject or cancel orders for reasons including pricing errors, product availability issues, suspected fraud, or violations of these Terms. If an order is cancelled after payment, a refund will be issued to the original payment method.
4. Pricing
Pricing errors may occur. NewTechBio, Inc. reserves the right to correct pricing or typographical errors and may cancel or refuse orders placed at an incorrect price. Prices are confirmed at the time of order processing.
5. Payment Authorization and Fraud Prevention
By submitting payment, you represent that you are authorized to use the selected payment method and that all information provided is accurate. We may use fraud screening tools and request additional verification. Orders flagged as high risk may be delayed or cancelled.
6. Taxes and Duties
Prices do not include applicable sales, use, value-added, excise, or similar taxes. Where required, such taxes will be added to your invoice.
For international shipments, you are the importer of record and are responsible for customs duties, VAT, brokerage fees, and related charges.
7. Shipping, Title, and Risk of Loss
Shipping procedures, transit estimates, tracking availability, freight approvals, return windows, and refund logistics are governed exclusively by the Shipping and Returns policy.
Title and risk of loss for all merchandise purchased from NewTechBio transfer to the purchaser when NewTechBio delivers the goods to the carrier for shipment. Once the carrier accepts the shipment, responsibility for damage or loss in transit is borne by the purchaser.
In the event of loss or damage during transit after the shipment has been accepted by the carrier, the purchaser must file all claims directly with the carrier. NewTechBio will provide reasonable assistance in supporting such claims, including providing shipment details and documentation we have available.
Damages or loss that occur after transfer to the carrier are handled between the customer and the carrier. NewTechBio is not responsible for carrier-caused loss or damage after acceptance by the carrier.
8. Product Use and Compliance
You agree to use NewTechBio products strictly in accordance with label directions and all applicable federal, state, and local laws and regulations. Products may not be used for unlawful or hazardous purposes.
You are solely responsible for verifying regulatory compliance in your jurisdiction.
9. Returns and Refunds
Returns and refunds are governed exclusively by the Shipping and Returns policy.
Unopened products in new condition may be returned within 30 days of delivery, subject to the procedures and refund terms stated in the Shipping and Returns policy.
10. Performance Guarantees
Performance guarantees applicable to specific products are described in the Shipping and Returns policy and on product labeling. Those guarantees are incorporated by reference into these Terms.
11. Warranty Limitations
Except for express guarantees stated in product labeling or the Shipping and Returns policy, products are sold “as is” and “as available,” and NewTechBio, Inc. disclaims all implied warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.
Products are warranted only to match the chemical descriptions on their labels when handled, stored, and used as directed.
Some jurisdictions do not allow limitations on implied warranties, so certain limitations may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, NewTechBio, Inc.’s total liability is limited to the purchase price paid for the product at issue or, at our option, replacement of the product.
NewTechBio, Inc. is not liable for consequential, incidental, indirect, punitive, or special damages, including lost profits or business interruption.
13. Indemnification
You agree to indemnify, defend, and hold harmless NewTechBio, Inc., its officers, directors, employees, agents, successors, and assigns from any claim, demand, loss, or damage, including reasonable attorney fees, arising out of your misuse of products, breach of these Terms, violation of law, or infringement of third-party rights.
14. Force Majeure
NewTechBio, Inc. is not liable for delay or failure to perform due to events beyond reasonable control, including natural disasters, severe weather, labor disruptions, transportation interruptions, supply shortages, governmental actions, or similar events.
15. Disclaimer of Professional Advice
All website content is provided for general informational purposes only and is not intended as medical, veterinary, engineering, legal, or professional advice. Consult a qualified professional for advice specific to your situation.
16. Third-Party Links
The website may contain links to third-party websites. NewTechBio, Inc. is not responsible for third-party content or services, and inclusion of a link does not imply endorsement.
17. Export Compliance
You may not purchase products or use our services in violation of United States export laws. You are responsible for ensuring products are not shipped, transferred, or used in restricted jurisdictions or for prohibited purposes.
18. Messaging
By verifying your phone number, you consent to receive SMS messages for login verification, password resets, and transactional notifications. Message frequency may vary. Message and data rates may apply.
19. Billing Dispute and Chargeback Policy
If you have a question regarding a charge, you must contact Customer Service within 30 days at 800-509-0927 or sales@newtechbio.com and allow reasonable opportunity for investigation.
Filing a chargeback without first contacting us may constitute a breach of these Terms to the extent permitted by applicable law and card network rules. NewTechBio, Inc. may contest unsupported chargebacks and may seek recovery of outstanding amounts where permitted by law, including filing fees and reasonable collection costs.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey.
Any dispute relating to products, services, or website use shall be resolved through binding arbitration administered by the American Arbitration Association in Mercer County, New Jersey. Either party may pursue an individual claim in Mercer County small claims court. Class actions and jury trials are waived.
21. Assignment
NewTechBio, Inc. may assign its rights and obligations under these Terms. You may not assign your rights without prior written consent.
22. No Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
23. Entire Agreement
These Terms, together with the Privacy Policy, Shipping and Returns policy, and Conditions of Use, constitute the entire agreement between you and NewTechBio, Inc. regarding use of the website and purchase of products.
